Nona Adventure Park Season Passholder Terms and Conditions

This Agreement (“Agreement”) is entered into by and between Nona Adventure Park (“Park”) and the individual purchaser (“Passholder”), collectively referred to as the “Parties.” By purchasing and/or using a season pass, Passholder agrees to the following terms and conditions:

  1. Term of Agreement

This Agreement shall commence on the date of purchase of the season pass and remain valid for the designated membership term as specified on the pass.

2. Nature of Membership

Membership is non-exclusive and does not grant any private access, rights, or privileges beyond those explicitly stated in the offer at the time of purchase. Membership is prepaid, meaning all fees are paid in advance and are non-refundable except as explicitly defined in this Agreement.

3. Passholder Rights and Benefits

Passholders are entitled to the rights and benefits as defined in the specific offer under which the pass was purchased. These benefits may include, but are not limited to:

• Access to Park facilities during regular operating hours, subject to capacity limitations.

• Discounts, perks, or promotions explicitly listed in the offer.

• Additional rights or privileges specified at the time of purchase.

The Park reserves the right to adjust or modify the rights and benefits for future offers, but the benefits for current passholders will remain as outlined in their original purchase terms for the duration of the membership.

Passholders do not receive priority over retail customers unless explicitly stated in the offer. Perks and benefits may be subject to availability and do not guarantee preferential treatment.

4. Membership Usage

• Passholders must check in at the designated location each time they visit the Park.

• Passholders must present their valid membership pass for entry and applicable discounts.

• Passes are non-transferable and can only be used by the individual named on the pass.

• Misuse or fraudulent activity will result in immediate termination without refund.

• Lost or stolen passes must be reported immediately. Replacement passes may incur a fee.

5. Park Rules and Behavior

• Passholders must adhere to all posted safety instructions and Park policies.

• Any Passholder who consistently violates rules or behaves in a manner inconsistent with the Park’s values may have their membership terminated without refund.

• Fraudulent submission of waivers, including forging signatures or misrepresenting legal guardianship, will result in immediate expulsion from the Park without refund.

• Access to the Park will be suspended until a valid waiver is submitted.

6. Park Operations, Closures, and Capacity Management

• The Park reserves the right to adjust operating hours, including temporary closures, due to weather, safety, maintenance, or business conditions.

• Passholders will be notified of significant changes via email or other communication methods.

• Closures will not result in refunds or extensions to membership terms.

Operating hours include capacity management; during peak periods, the Park may implement restrictions to ensure a safe and enjoyable experience for all guests. Passholder entry is subject to availability and does not guarantee immediate access during high-capacity periods.

7. Payment and Refund Policy

Finality of Payments: All payments made for memberships, passes, or any Park-related services are final.

No refunds, credits, or exchanges will be provided for unused time, missed days, or failure to utilize memberships or passes.

• Any exceptions to this policy will be explicitly noted in the terms of a specific promotion or agreement.

8. Assumption of Risk and Waiver Requirement

• All members must have a valid and current waiver on file to access the Park and its activities.

• For minors, waivers must be completed and signed by a legal guardian.

• Fraudulent submission of waivers will result in immediate expulsion from the Park without refund.

• Access to the Park will be suspended until a valid waiver is submitted.

• Passholders acknowledge that participation in activities at the Park involves inherent risks, and they voluntarily assume these risks.

9. Membership Modifications

• The Park reserves the right to alter membership benefits, terms, or pricing for future renewals.

• Existing members will retain their current pricing until the end of their membership term unless notified otherwise.

10. Refunds and Cancellations

Passes are non-refundable except as specified below:

• Within 30 days of purchase (if unused).

• Signup fees are non-refundable under any circumstances.

• Passholders may cancel their membership at any time, but no refunds will be issued for unused time or intra-month cancellations.

11. Governing Law

This Agreement is governed by the laws of the State of Florida. Any disputes shall be resolved in the courts of that jurisdiction.

12. Severability

If any provision of this Agreement is deemed invalid or unenforceable, the remaining provisions will remain in full force and effect.

Acknowledgment

By purchasing and using the season pass, the Passholder agrees to the terms and conditions outlined in this Agreement.
